Terms & Conditions

KIDBUDDIE TERMS AND CONDITIONS

Effective 1 July 2026

These Terms and Conditions govern the sale, manufacture, delivery, installation, and use of playground equipment supplied by KidBuddie (“the Company”). By accepting a quotation, placing an order, making payment, or accepting delivery of goods, the customer agrees to these Terms and Conditions.

 

1. QUOTATIONS

1.1 All quotations are valid for 30 days from the date of issue unless otherwise stated.

1.2​ Prices are subject to change after the validity period due to fluctuations in material, transport, or labour costs.

1.3​ Quotations are based on the information supplied by the customer and may be amended if site conditions differ from those initially disclosed.

 

2. ORDERS AND MANUFACTURING

2.1​ Production will only commence upon receipt of the required deposit and confirmation of the order.

2.2 ​Estimated manufacturing periods are generally between 4 and 6 weeks, subject to production schedules and material availability.

2.3 ​Any changes requested after production has commenced may result in additional costs and revised manufacturing dates.

2.4 ​Custom-made products are manufactured according to customer specifications and may not be cancelled once production has begun.

 

3. PAYMENT TERMS

3.1​ A deposit of 70% of the total order value is required before manufacturing commences.

3.2 ​The remaining balance is payable upon completed manufacturing, delivery, or completion of installation, whichever occurs last.

3.3​ Ownership of all products remains vested in KidBuddie until full payment has been received.

3.4​ In the event of late payment, the customer shall be liable for all legal, collection, and recovery costs​incurred by KidBuddie.

 

4. DELIVERY

4.1​ Delivery dates are estimates only and may be affected by circumstances beyond KidBuddie’s control.

4.2​ KidBuddie shall not be liable for any indirect or consequential losses arising from delivery delays.

 

5. INSTALLATION

5.1​ Installation pricing is based on reasonably level ground that is free from obstructions and suitable for normal excavation.

5.2​ Installation prices exclude:

  • Removal or reinstatement of paving, concrete, tar, brickwork, or other hard surfaces.
  • Site preparation not disclosed during quotation.
  • Generator hire, fuel, or additional equipment required due to site conditions.
  • Health and Safety file costs
5.3 ​Installation rates assume that an electrical power point is available within 30 metres of the installation area.
5.4 ​The customer is responsible for identifying all underground services, including water pipes, electrical cables, drainage systems, and communication lines. KidBuddie accepts no liability for damage to undisclosed underground services.

 

6. PRODUCT MATERIALS

6.1​ KidBuddie primarily uses pressure-treated Pinus Radiata timber selected for strength, durability, and suitability for outdoor use.

6.2 ​Timber is a natural product and may develop surface cracks, checking, knots, colour variations, or minor movement due to environmental conditions. These characteristics do not constitute defects.

6.3​ Customers are strongly encouraged to varnish, stain, or oil timber surfaces and maintain protective coatings regularly.

 

7. WARRANTY

7.1 ​KidBuddie warrants that its products are free from defects in materials and workmanship for a period of twelve (12) months from the date of delivery or installation.

7.2​ During the warranty period, KidBuddie may repair, replace, or exchange defective components at its discretion.

7.3 ​The warranty does not cover:

  • Normal wear and tear;
  • Weathering and environmental exposure;
  • Improper maintenance;
  • Vandalism;
  • Misuse or abuse;
  • Modifications made by third parties;
  • Damage resulting from incorrect installation not performed by KidBuddie.

8. CUSTOMER MAINTENANCE RESPONSIBILITIES

8.1​ The customer is responsible for ongoing inspection, maintenance, and safe operation of all playground equipment.

8.2 ​Equipment should be inspected at least monthly and more frequently in high-use environments.

8.3​ The customer must regularly:

  • Check all bolts, fixings, ropes, chains, and moving parts;
  • Lubricate moving components where required;
  • Repair or replace worn or damaged components;
  • Ensure there are no sharp edges, protrusions, or hazards;
  • Maintain protective coatings on timber surfaces.

 

9. SAFETY AND SUPERVISION

9.1 ​Playground equipment should be used only for its intended purpose.

9.2​ Children should be supervised by a responsible adult while using playground equipment.

9.3 ​Children under six (6) years of age should always have adult supervision.

9.4 ​The customer is responsible for ensuring that the equipment remains safe and compliant with any applicable safety requirements after installation.

 

10. LIMITATION OF LIABILITY

10.1​ While KidBuddie takes every reasonable precaution in the design, manufacture, and installation of its products, playground activities involve inherent risks.

10.2 ​To the maximum extent permitted by law, KidBuddie shall not be liable for any injury, death, loss, damage, or expense arising from:

  • Improper use of the equipment;
  • Lack of supervision;
  • Failure to maintain the equipment;
  • Alterations made after installation;
  • Misuse, vandalism, or negligence by users.
10.3​ KidBuddie’s liability shall in all cases be limited to the value of the products supplied.

11. INDEMNITY

The customer agrees to indemnify and hold harmless KidBuddie, its directors, employees, contractors, and representatives against any claims, damages, losses, liabilities, or costs arising from:

The use of the playground equipment;
Failure to properly maintain the equipment;
Failure to adequately supervise users;
Any modifications made after installation.

12. FORCE MAJEURE

KidBuddie shall not be liable for any delay or failure to perform its obligations due to events beyond its reasonable control, including but not limited to acts of God, extreme weather, labour disputes, transportation disruptions, material shortages, pandemics, or government restrictions.

 

13. PRIVACY

Any personal information collected by KidBuddie shall be processed in accordance with applicable South African privacy laws, including the Protection of Personal Information Act (POPIA).

 

14. GOVERNING LAW

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.

Any disputes arising from these Terms and Conditions shall be subject to the jurisdiction of the South African courts.

 

15. ACCEPTANCE

By accepting a quotation, signing an order, making payment, or accepting delivery of products, the customer acknowledges that they have read, understood, and accepted these Terms and Conditions.
